    • TERMS & CONDITIONS

    1. Agreement

    These Terms govern the provision of WordPress development services by XAMAK23 (“we”, “us”) to clients (“you”). By engaging our services, you accept these terms.

    2. Services

    We provide WordPress development, design, and related services as specified in project agreements. Specific deliverables, timelines, and costs are detailed in individual project proposals.

    3. Service Models

    Managed Service: We set up and maintain hosting infrastructure. You receive WordPress admin access. Monthly maintenance fees apply.

    Full Handover: We deliver complete website files and database. You manage all hosting and technical aspects independently.

    4. Payment Terms

    • Payment structure as agreed in project proposal (typically 40%-40%-20%)
    • Invoices payable within 30 days
    • Prices exclude VAT (20% for Bulgarian clients)
    • Late payments may result in service suspension
    • No hidden fees – all costs specified upfront

    5. Client Obligations

    You agree to provide:

    • Clear project requirements
    • Timely feedback and approvals
    • Content and brand assets as needed
    • Prompt payment per agreed terms

    You are responsible for:

    • Content accuracy and legality
    • Maintaining necessary licenses
    • GDPR compliance for data collection
    • Keeping access credentials secure

    6. Intellectual Property

    • You own custom work created for your project upon full payment
    • We retain rights to our tools, frameworks, and methodologies
    • WordPress, themes, and plugins remain under their respective licenses
    • We may showcase your project in our portfolio unless you object

    7. Warranties and Limitations

    We guarantee:

    • Professional quality work
    • Compliance with agreed specifications
    • 30-day warranty for bug fixes

    We do not guarantee:

    • Specific business results or rankings
    • Compatibility with all future updates
    • Complete security against all threats
    • Uninterrupted operation

    Liability Limitation:
    Our maximum liability is limited to the project fee paid. We are not responsible for indirect damages, lost profits, or data loss.

    8. Confidentiality

    Both parties agree to keep confidential information private. This includes business information, technical data, and access credentials.

    9. Data Protection

    We comply with GDPR requirements. When processing personal data on your behalf, we act as data processor. You remain the data controller and are responsible for privacy compliance on your website.

    10. Termination

    For Projects:

    • Either party may terminate with 15 days notice
    • You pay for work completed to date
    • Advance payments are non-refundable for completed work

    For Ongoing Services:

    • Either party may terminate with 30 days notice
    • Unused prepaid services will be refunded

    11. Dispute Resolution

    Disputes will be resolved through:

    1. Good faith negotiation
    2. Mediation if needed
    3. Bulgarian courts as final resort

    Governed by Bulgarian law.

    12. General Terms

    • Changes require written agreement
    • We may use subcontractors while maintaining responsibility
    • Neither party may assign without consent
    • Force majeure events excuse performance delays
    • These terms represent our entire agreement
