TERMS & CONDITIONS<\/h2>\n\n\n\n

1. Agreement<\/h3>\n\n\n\n

These Terms govern the provision of WordPress development services by XAMAK23 (“we”, “us”) to clients (“you”). By engaging our services, you accept these terms.<\/p>\n\n\n\n

2. Services<\/h3>\n\n\n\n

We provide WordPress development, design, and related services as specified in project agreements. Specific deliverables, timelines, and costs are detailed in individual project proposals.<\/p>\n\n\n\n

3. Service Models<\/h3>\n\n\n\n

Managed Service:<\/strong> We set up and maintain hosting infrastructure. You receive WordPress admin access. Monthly maintenance fees apply.<\/p>\n\n\n\n

Full Handover:<\/strong> We deliver complete website files and database. You manage all hosting and technical aspects independently.<\/p>\n\n\n\n

4. Payment Terms<\/h3>\n\n\n\n

  • Payment structure as agreed in project proposal (typically 40%-40%-20%)<\/li>\n\n\n\n
  • Invoices payable within 30 days<\/li>\n\n\n\n
  • Prices exclude VAT (20% for Bulgarian clients)<\/li>\n\n\n\n
  • Late payments may result in service suspension<\/li>\n\n\n\n
  • No hidden fees – all costs specified upfront<\/li>\n<\/ul>\n\n\n\n

    5. Client Obligations<\/h3>\n\n\n\n

    You agree to provide:<\/p>\n\n\n\n

    • Clear project requirements<\/li>\n\n\n\n
    • Timely feedback and approvals<\/li>\n\n\n\n
    • Content and brand assets as needed<\/li>\n\n\n\n
    • Prompt payment per agreed terms<\/li>\n<\/ul>\n\n\n\n

      You are responsible for:<\/p>\n\n\n\n

      • Content accuracy and legality<\/li>\n\n\n\n
      • Maintaining necessary licenses<\/li>\n\n\n\n
      • GDPR compliance for data collection<\/li>\n\n\n\n
      • Keeping access credentials secure<\/li>\n<\/ul>\n\n\n\n

        6. Intellectual Property<\/h3>\n\n\n\n

        • You own custom work created for your project upon full payment<\/li>\n\n\n\n
        • We retain rights to our tools, frameworks, and methodologies<\/li>\n\n\n\n
        • WordPress, themes, and plugins remain under their respective licenses<\/li>\n\n\n\n
        • We may showcase your project in our portfolio unless you object<\/li>\n<\/ul>\n\n\n\n

          7. Warranties and Limitations<\/h3>\n\n\n\n

          We guarantee:<\/strong><\/p>\n\n\n\n

          • Professional quality work<\/li>\n\n\n\n
          • Compliance with agreed specifications<\/li>\n\n\n\n
          • 30-day warranty for bug fixes<\/li>\n<\/ul>\n\n\n\n

            We do not guarantee:<\/strong><\/p>\n\n\n\n

            • Specific business results or rankings<\/li>\n\n\n\n
            • Compatibility with all future updates<\/li>\n\n\n\n
            • Complete security against all threats<\/li>\n\n\n\n
            • Uninterrupted operation<\/li>\n<\/ul>\n\n\n\n

              Liability Limitation:<\/strong>
              Our maximum liability is limited to the project fee paid. We are not responsible for indirect damages, lost profits, or data loss.<\/p>\n\n\n\n

              8. Confidentiality<\/h3>\n\n\n\n

              Both parties agree to keep confidential information private. This includes business information, technical data, and access credentials.<\/p>\n\n\n\n

              9. Data Protection<\/h3>\n\n\n\n

              We comply with GDPR requirements. When processing personal data on your behalf, we act as data processor. You remain the data controller and are responsible for privacy compliance on your website.<\/p>\n\n\n\n

              10. Termination<\/h3>\n\n\n\n

              For Projects:<\/strong><\/p>\n\n\n\n

              • Either party may terminate with 15 days notice<\/li>\n\n\n\n
              • You pay for work completed to date<\/li>\n\n\n\n
              • Advance payments are non-refundable for completed work<\/li>\n<\/ul>\n\n\n\n

                For Ongoing Services:<\/strong><\/p>\n\n\n\n

                • Either party may terminate with 30 days notice<\/li>\n\n\n\n
                • Unused prepaid services will be refunded<\/li>\n<\/ul>\n\n\n\n

                  11. Dispute Resolution<\/h3>\n\n\n\n

                  Disputes will be resolved through:<\/p>\n\n\n\n

                  1. Good faith negotiation<\/li>\n\n\n\n
                  2. Mediation if needed<\/li>\n\n\n\n
                  3. Bulgarian courts as final resort<\/li>\n<\/ol>\n\n\n\n

                    Governed by Bulgarian law.<\/p>\n\n\n\n

                    12. General Terms<\/h3>\n\n\n\n

                    • Changes require written agreement<\/li>\n\n\n\n
                    • We may use subcontractors while maintaining responsibility<\/li>\n\n\n\n
                    • Neither party may assign without consent<\/li>\n\n\n\n
                    • Force majeure events excuse performance delays<\/li>\n\n\n\n
                    • These terms represent our entire agreement<\/li>\n<\/ul>\n\n\n\n
